Terms of Service

These Terms of Service ("Terms") govern your use of the Money Caddie mobile application (the "App") operated by Bat City Birdies LLC ("we," "us," or "our"), a Texas limited liability company based in Austin, TX.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
2. Account Registration
To use certain features, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activity under your account.
3. Description of Service
Money Caddie is a golf scoring and bet tracking application. The App allows users to:
- Track scores during a round of golf
- Configure and track various betting formats (skins, nassau, stroke play, wolf, and custom bets)
- Calculate settlements between players at the end of a round
- View round history and scoring summaries
- Participate in hosted scramble tournaments
The App is a scoring and calculation tool only. We do not facilitate, process, or hold any monetary transactions. All financial settlements between players occur outside the App through the players' own chosen payment methods.
4. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws regarding gambling or wagering
- Impersonate any person or entity
- Interfere with or disrupt the App or its servers
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse engineer, decompile, or disassemble the App
- Use automated scripts or bots to interact with the App
5. Betting and Wagering Disclaimer
Money Caddie is a scorecard and calculator tool that helps golfers track friendly wagers during a round. The App does not:
- Accept, hold, or transfer money or anything of value
- Operate as a gambling platform, sportsbook, or betting exchange
- Facilitate online gambling
- Guarantee or enforce payment between users
All bets tracked in the App are social agreements between players. Users are solely responsible for ensuring their use of the App complies with all applicable laws in their jurisdiction.
6. Hosted Scramble Events
Tournament hosts who use the App to manage scramble events are responsible for obtaining any necessary permits or approvals, ensuring compliance with applicable laws, managing player registration, and the accuracy of event information.
We are not a co-organizer, sponsor, or participant in any hosted event. We provide the technology platform only.
7. Intellectual Property
The App, including its design, code, graphics, logos, and content, is owned by Bat City Birdies LLC and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. User Content
You retain ownership of any content you submit. By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content as necessary to operate the App.
9. Privacy
Your use of the App is also governed by our Privacy Policy.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAT CITY BIRDIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Bat City Birdies LLC from any claims arising from your use of the App, violation of these Terms, violation of any applicable law, or any dispute between you and another user.
13. Termination
We may suspend or terminate your access at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately.
14. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
15. Changes to These Terms
We may update these Terms from time to time. Continued use after changes constitutes acceptance.
16. Severability
If any provision is found unenforceable, the remaining provisions continue in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bat City Birdies LLC regarding your use of the App.
